These Terms and Conditions, also referred to as the “Terms,” govern your access to and use of damebody.com, your purchase and use of Dame Body products, and your participation in Dame Body programs, promotions, events, rewards, and other services.
Dame Body Butters & Scrubs may also be referred to as “Dame Body,” “we,” “us,” or “our.” The words “you” and “your” refer to website visitors, customers, account holders, subscribers, promotion participants, and others who interact with Dame Body.
By accessing our website, creating an account, placing an order, submitting information, or using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the website or purchase our products.
1. ABOUT DAME BODY
Dame Body is a woman-owned plant-based skincare and body-care company based in Livingston, Alabama.
Our cosmetic personal-care products are freshly prepared in small batches and may include botanical oils, butters, herbs, fruit powders, clays, salts, aromatic ingredients, and other formula-specific materials.
Product ingredients, sizes, aromas, availability, prices, packaging, and descriptions may vary by product.
2. ELIGIBILITY
You must be at least 18 years old or the age of legal majority where you live to place an order, create an account, or enter into a binding purchase agreement with Dame Body.
A parent or legal guardian must supervise purchases made for or by a minor.
You agree to provide accurate, complete, and current information when using our website or placing an order.
3. WEBSITE USE
You may use our website only for lawful personal and commercial-shopping purposes consistent with these Terms.
You may not:
- Use the website for fraud, abuse, harassment, or unlawful activity

- Natural materials may show reasonable batch-to-batch differences
- Product photographs may include styling materials that are not included with the purchase
Always review the product page, available ingredient information, size selection, aroma selection, and usage directions before ordering.
If a material error affects an order, contact us so we can review the matter.
6. COSMETIC USE AND MEDICAL DISCLAIMER
Dame Body products are cosmetic personal-care products intended to cleanse, exfoliate, moisturize, scent, and support the feel or appearance of the skin.
Dame Body products and website content are not intended to diagnose, treat, cure, or prevent disease, infection, eczema, acne, or another medical condition.
Our products, website, blog, social media, workshops, questionnaires, and educational materials are not substitutes for medical advice, diagnosis, or treatment.
Consult a qualified healthcare professional regarding:
- Medical conditions
- Persistent skin symptoms
- Allergies
- Pregnancy or nursing
- Prescription products
- Medication interactions
- Serious or recurring reactions
- Questions about whether an ingredient is appropriate for you
Individual experiences and results vary. We do not guarantee a particular cosmetic result, transformation, or timeframe.
7. ALLERGIES, SENSITIVITIES, AND PATCH TESTING
Natural and plant-derived ingredients can still cause allergies or sensitivities.
Review the product’s ingredient information before use, particularly if you have known allergies or sensitivities to:

- Herbs
- Essential oils

Patch test new products on a small area before broader use.
Do not apply products to broken, irritated, sunburned, or infected skin unless directed by an appropriate healthcare professional.
Discontinue use if persistent redness, swelling, burning, itching, or another unwanted reaction occurs. Seek appropriate medical care for a serious reaction.
8. PRODUCT USE AND SAFETY
Follow the directions provided on the product page, label, packaging, or accompanying materials.
Use only products specifically labeled for facial use on the face.
Avoid contact with eyes and other sensitive areas. Keep products away from children and pets unless the product is specifically intended for supervised use by that age group.
Body oils and scrubs may make showers, tubs, and floors slippery. Use care during and after application.
You accept responsibility for reviewing ingredients and using products appropriately.
9. PRICES AND AVAILABILITY
All prices are displayed in U.S. dollars unless otherwise stated.
Prices, promotions, product availability, packaging, sizes, and offers may change without advance notice.
Placing an item in your cart does not reserve the item or guarantee its price or availability.
We may limit quantities, discontinue products, correct errors, or refuse orders when reasonably necessary.
Applicable taxes, shipping charges, and other disclosed costs are added during checkout.
10. ORDER ACCEPTANCE
Submitting an order does not automatically mean that Dame Body has accepted it.
We may review, refuse, limit, or cancel an order for reasons including:
- Incorrect pricing or product information
- Product or ingredient unavailability
- Suspected fraud
- Payment problems
- Shipping restrictions
- Duplicate orders
- Promotion or rewards misuse
- Unusually large quantities
- Website or inventory errors
- Inability to fulfill a requested customization
- Violation of these Terms
If we cancel a paid order, we will issue an appropriate refund for the canceled amount.
An order confirmation acknowledges that we received the order. A shipping confirmation indicates that the order has entered shipment.
11. PAYMENT
Payment is due at checkout using an available payment method.
Payments are processed by authorized third-party payment providers. Their terms and privacy practices may also apply to your transaction.
You represent that:
- The payment information you submit is accurate
- You are authorized to use the selected payment method
- The transaction does not violate applicable law
- You will pay all properly disclosed charges
We are not responsible for fees charged by your bank, card issuer, mobile carrier, or payment provider.
12. MADE-TO-ORDER PROCESSING
Dame Body products are freshly made to order.
Orders generally require 5 to 7 business days for preparation before shipment. Preparation may include sourcing, blending, setting, filling, labeling, packaging, and final quality review.
Processing estimates may be affected by:
- Holidays
- High order volume
- Ingredient availability
- Packaging availability
- Weather
- Power or service interruptions
- Product curing, cooling, or setting requirements
- Circumstances outside our reasonable control
We will communicate material delays when reasonably possible.
13. SHIPPING AND DELIVERY
Carrier transit generally takes an additional 3 to 8 business days after preparation.
Please allow approximately 8 to 15 business days from ordering through delivery.
Shipping rates are calculated by package weight. Orders of $150 or more qualify for free standard shipping.
Available shipping methods, costs, and estimates are displayed during checkout before payment.
Delivery dates are estimates, not guarantees. Carriers operate independently and may experience weather, staffing, routing, holiday, security, or operational delays.
Dame Body currently ships within the United States and Puerto Rico according to the options available at checkout.

14. SHIPPING ADDRESSES
You are responsible for providing a complete and accurate shipping address.
Review the following before submitting an order:
- Recipient name
- Street address
- Apartment, suite, or unit number
- City
- State or territory
- ZIP code
- Telephone number
- Email address
Contact us immediately if an address correction is needed. We cannot guarantee changes after preparation begins, the order is packed, or a shipping label is created.
Customers may be responsible for additional shipping costs when a package is returned or delayed because of an incorrect, incomplete, refused, or undeliverable address.
15. RISK OF LOSS AND DELIVERY
Risk of loss transfers as permitted by applicable law and the terms of the shipping carrier.
Tracking information may take time to update after the carrier receives the package.
If tracking shows delivered but the package cannot be found, check:
- The mailbox
- Porch and side entrances
- Household members
- Neighbors
- Building management
- Parcel lockers
- Other carrier-designated delivery areas
Contact the carrier and Dame Body promptly if a package remains missing.
We will assist with available information, but carrier investigations and resolutions may require additional time.
16. HEAT-SENSITIVE PRODUCTS
Whipped body butters and certain other products may soften or melt in warm temperatures during shipment or after delivery.
Customers should retrieve packages promptly and avoid leaving them in:
- Hot mailboxes
- Direct sunlight
- Vehicles
- Porches exposed to heat
- Other high-temperature locations
Melting does not automatically mean the product is spoiled. Cooling the closed container upright may restore firmness, although the original whipped appearance may change.
Contact us within seven days of delivery if a product arrives leaking, open, damaged, or significantly compromised.
17. ORDER CHANGES AND CANCELLATIONS
Because products are made to order, contact us as soon as possible to request a change or cancellation.
We cannot guarantee changes or cancellations after:
- Preparation has begun
- Ingredients have been allocated
- Custom selections have been prepared
- An order has been packed
- A shipping label has been created
- An order has entered shipment
Approved cancellations will be handled according to the order status, work completed, payment method, and applicable law.
18. RETURNS, EXCHANGES, AND ORDER ISSUES
Because Dame Body products are freshly made-to-order personal-care items, we do not accept general returns or restock opened, used, or customized products.
We accept returns for defective products and exchanges for eligible unopened, unused products.
Contact us within seven days of delivery with:
- Your order number
- Product name
- Description of the issue
- Clear photographs of the product
- Photographs of the shipping box and packaging when relevant
We may request additional information needed to review the issue.
19. DAMAGED, DEFECTIVE, MELTED, LEAKING, OR INCORRECT ORDERS
If an order arrives incorrect, damaged, defective, melted, leaking, or otherwise compromised in transit, contact us within seven days of delivery.
After reviewing the available information, Dame Body may provide an appropriate:
- Replacement
- Exchange
- Refund
- Store credit
- Other reasonable resolution
The appropriate resolution depends on the order, product condition, available evidence, inventory, and circumstances.
Do not discard damaged products or packaging until we confirm that they are no longer needed for review.
20. EXCHANGE COSTS AND REFUNDS
Approved preference-based exchanges must be unopened and unused.
Customers are responsible for return shipping costs for approved preference-based exchanges.
Dame Body covers reasonable shipping costs when an order arrives incorrect, defective, or damaged in transit.
Original shipping charges are nonrefundable unless the issue resulted from our error.
No restocking fee applies to approved returns or exchanges.
Approved refunds are issued to the original payment method when reasonably possible. Financial institutions may require additional time to post a refund.
21. PROMOTIONS AND DISCOUNT CODES
Promotions may be subject to separate terms, including:
- Start and end dates
- Product exclusions
- Order minimums
- Customer limits
- Geographic restrictions
- Redemption limits
- Unique or single-use codes
Unless a promotion states otherwise:
- Only one discount code may be used per order
- Discount codes cannot be combined
- Discounts cannot be applied after checkout
- Promotions have no cash value
- Promotions cannot be reproduced, sold, or transferred
- Taxes and shipping may not count toward order minimums
- Returned, canceled, or refunded items may affect promotional eligibility
We may cancel or restrict a promotion affected by fraud, misuse, technical errors, or circumstances outside our reasonable control.
22. DAME GLOW REWARDS
Participation in Dame Glow Rewards is subject to the current program information displayed on our website.
Rewards, points, benefits, referral credits, redemption levels, expiration rules, and eligibility requirements may change.
Rewards:
- Have no cash value unless expressly stated
- Are not property
- May not be transferred or sold
- May be canceled if obtained through fraud, manipulation, duplicate accounts, or misuse
- May be adjusted when an order is canceled, refunded, disputed, or returned
We may modify, pause, or discontinue the program as permitted by law.
23. GIFT CARDS AND STORE CREDIT
If Dame Body offers gift cards or store credit, additional terms displayed at purchase or issuance may apply.
Gift cards and store credit:
- Are not redeemable for cash except where required by law
- Must be used according to their stated terms
- May not be replaced if lost, stolen, or used without authorization unless required by law
- May not be used for unlawful or fraudulent purposes
24. REVIEWS AND USER CONTENT
You may be able to submit reviews, photographs, comments, testimonials, survey responses, social-media tags, or other content.
You represent that content you submit:
- Is accurate and based on your genuine experience
- Does not violate another person’s privacy or intellectual-property rights
- Is not unlawful, threatening, hateful, obscene, defamatory, or deceptive
- Does not contain malware, spam, or unauthorized advertising
- Does not include confidential or highly sensitive information
You retain ownership of your original content.
When you submit content directly for publication on our website, you grant Dame Body a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and use that content for operating and promoting Dame Body, subject to applicable law.
We will seek additional permission where required for promotional use of customer photographs or content.
We may remove content that violates these Terms or applicable law.
25. INTELLECTUAL PROPERTY
The website and its content are owned by or licensed to Dame Body and are protected by applicable intellectual-property laws.
Protected content may include:
- Dame Body names and logos
- The Dame Glowing Skin Method™
- Product names
- Product descriptions
- Photographs
- Graphics
- Videos
- Labels
- Packaging designs
- Educational materials
- Workshop materials
- Blog content
- Website layout
- Original text and artwork
You may view and use the website for personal shopping and informational purposes.
You may not copy, reproduce, modify, publish, distribute, sell, license, scrape, or commercially exploit protected content without written permission.
26. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to social media, payment services, shipping carriers, surveys, event platforms, affiliate partners, or other third-party websites.
Dame Body does not control and is not responsible for third-party content, availability, security, terms, privacy practices, products, or services.
Access third-party services at your own discretion and review their policies.
27. EMAIL AND TEXT COMMUNICATIONS
By providing your email address, you agree to receive transactional communications related to:

- Shipping
- Delivery

You may also receive marketing emails if you subscribe or where otherwise permitted. Use the unsubscribe link in a marketing email to opt out.
If you voluntarily subscribe to marketing text messages, message frequency may vary and message and data rates may apply. Consent to marketing texts is not required as a condition of purchase.
Reply STOP to opt out or HELP for assistance when supported by the messaging program.
28. PRIVACY
Our collection and use of personal information are described in our Privacy Policy.
By using the website, you acknowledge that information may be processed by Dame Body and service providers needed to operate the store, process orders, complete payments, deliver packages, provide communications, prevent fraud, and support other described purposes.
29. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website, content, and services are provided on an “as available” and “as is” basis.
Dame Body does not guarantee that:
- The website will always be uninterrupted or error-free
- Every product will be continuously available
- Every description or image will be free from minor errors
- A product will produce the same result for every person
- Delivery will occur on a guaranteed date
- Third-party services will remain available
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
30. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Dame Body will not be liable for indirect, incidental, special, punitive, or consequential damages arising from website use, product use, delivery delays, third-party services, or these Terms.
Where liability cannot be excluded, Dame Body’s total liability relating to a purchase will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.
This section does not limit liability that cannot legally be limited.
31. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Dame Body harmless from claims, losses, liabilities, damages, and reasonable expenses arising from:

- Fraud or misuse committed through your account

- Your violation of another person’s rights
This obligation does not apply where prohibited by law.

- Other events beyond our reasonable control
We will make reasonable efforts to communicate material delays and resume performance when practical.
33. GOVERNING LAW
These Terms are governed by the laws of the State of Alabama and applicable federal law, without regard to conflict-of-law principles.
Nothing in these Terms removes consumer rights that cannot be waived under applicable law.
34. DISPUTE RESOLUTION
Before filing a formal claim, you agree to contact Dame Body and make a good-faith effort to resolve the matter informally.
Send a written description of the issue, your order number if applicable, and your requested resolution to thedamesannae@damebody.com.
If the matter cannot be resolved informally, either party may pursue available remedies under applicable law.
35. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
The invalid provision will be interpreted or limited to the extent necessary to make it enforceable where permitted by law.
36. NO WAIVER
If Dame Body does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
A waiver is effective only if made in writing by an authorized representative of Dame Body.
37. ASSIGNMENT
You may not assign your rights or obligations under these Terms without written permission from Dame Body.
Dame Body may assign these Terms as part of a merger, sale, restructuring, financing, transfer, or other lawful business transaction.
38. ENTIRE AGREEMENT
These Terms, our Privacy Policy, Shipping & Returns Policy, and any product-specific or promotion-specific terms form the agreement between you and Dame Body concerning your website use and purchases.
If product-specific or promotion-specific terms conflict with these general Terms, the more specific terms control for that product or promotion.
39. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our business, website, products, programs, legal obligations, or practices.
The updated Terms become effective when posted unless a later date is stated.
We will update the “Last Updated” date and provide additional notice when required by law.
